Applies To: All eligible Njord smartwatches enrolled in NjordCare+ Protection (Subscription Model)
1. Overview
NjordCare+ Protection is a subscription-based extended protection plan offered by Njord Gear Co. to provide added coverage for your Njord smartwatch. This Plan is designed to protect against accidental damage, hardware failures, and (under specified conditions) theft or loss. The Plan is available via monthly subscription and is cancellable at any time as outlined in Section 6.
2. Eligibility & Enrollment
To be eligible for coverage under this Plan:

The Covered Device must be purchased new from Njord Gear Co. or an authorized reseller.

Enrollment must occur either at the time of purchase or within thirty (30) days of the original retail purchase date.

The device must be in functional and undamaged condition at the time of enrollment.
3. Coverage Details
a. Covered Events ("Service Events")
Eligible subscribers are entitled to up to two (2) Service Events per calendar year. Covered Service Events include:

Accidental Damage from Handling (ADH), only after the initial 30-day money-back guarantee period:

Cracked or shattered screen
-
Internal water damage
-
Structural casing damage
-
Battery malfunction (if the device fails to power on due to battery failure)
-
Breakage of the original Njord Gear strap included with the device
-
One (1) replacement of the Njord Gear charger unit included with the purchase (counts as a Service Event)

Theft or loss (subject to Section 5)
b. Exclusions
The following are not covered under this Plan:

Cosmetic damage (e.g., scratches, dents, discoloration) that does not impair functionality

Damage due to abuse, negligence, unauthorized modifications, or third-party servicing
-
Accessories not originally included in the retail package (e.g., optional straps, docks, chargers)
-
Claims occurring after cancellation or lapse of the subscription
4. Service Process
All Service Events must be initiated through Njord Support.
Each approved Service Event may be subject to a non-refundable Service Fee, determined by the type of damage and the model of the Covered Device:

For Base Model devices: a flat $19 USD administrative fee applies to all approved theft or loss claims

For APEX Model devices: a flat $29 USD administrative fee applies to all approved theft or loss claims
These fees cover verification, logistics, and replacement handling. Applicable taxes may apply.
Customers are not required to return the damaged unit. Replacements may be new or refurbished Njord Gear devices with equivalent or better functionality.
The Plan term continues with the replacement unit.
5. Theft or Loss Protection
This Plan includes protection against theft or loss only after thirty (30) days from the first successful subscription billing. Coverage will apply if the following conditions are met:

A valid police report or a carrier-verified loss declaration is submitted to Njord Support

The subscriber confirms that the "Find My Watch" feature was used but the device remained unrecoverable
-
The subscription remained active and in good standing for the 30-day qualifying period before the claim
If theft or loss occurs prior to satisfying the qualifying threshold, the incident will be recorded as a Service Event, but no replacement or reimbursement will be provided.
6. Cancellation Policy
a. Subscriber-Initiated Cancellation

Subscribers may cancel their NjordCare+ Protection subscription at any time via the Njord Gear website or by submitting a written request to customer support.

No refunds will be issued for any monthly subscription charges incurred prior to cancellation.

If a Service Event has already been claimed, cancellation will not result in a refund or prorated reimbursement.
b. Provider-Initiated Cancellation

Njord Gear Co. may cancel the Plan in cases involving suspected fraud, misrepresentation, or failure to pay monthly fees.

Written notice of cancellation will be provided in advance, unless prohibited by applicable law.
7. Transferability
This Plan may be transferred to a new device owner if:

The subscription remains active and in good standing
-
The new owner contacts Njord Support to provide updated ownership and contact information
8. Unserviceable Claims
If Njord Gear is unable to repair or replace the Covered Device due to parts unavailability, model discontinuation, or any other reason:

A store credit equal to the original device purchase value may be issued, or
-
A cash refund may be offered at Njord Gear’s sole discretion
9. General Terms
This Plan is subject to and incorporates the Njord Gear Privacy Policy, Terms of Service, and Return Policy, available at:

This Plan is governed by the laws of the Province of Quebec and the applicable laws of Canada.
For Quebec residents:

This Plan is subject to the legal warranty under the Consumer Protection Act, ensuring goods are fit for normal use for a reasonable period and free of hidden defects.

This Plan offers additional benefits that do not limit your rights under Quebec law.

You may be entitled to a prorated refund upon cancellation in accordance with Quebec consumer law.
Dispute Resolution (Non-Quebec Residents Only)
Except where prohibited by law, any disputes arising from or related to this Plan shall be resolved by final and binding arbitration, administered by an independent arbitrator chosen by Njord Gear. This clause does not apply to residents of Quebec.
In case of any dispute, both parties agree to attempt resolution in good faith.
10. Purchase Option Cancellation Policy

Subscribers may cancel their NjordCare+ subscription at any time

Coverage remains active through the end of the current billing cycle

No refunds are issued for any previous billing cycles
-
Coverage will lapse immediately if subscription payment fails or is paused
